Yay! 😀 Please note that regardless of the duration of your stay, our cleaning fee is exactly what our cleaners charge us, not a penny more (more details in “other details to note section”). It includes full sanitation plus pool and hot tub maintenance at every turn to ensure everything is sparkling clean and ready for your stay. Some guests are still not comfortable with this additional fee so because of this, our space may be more suitable for longer stays to offset the cost of cleaning.

✹ When in Texas, try the Cowboy Pool, a galvanized steel stock tank! This is NOT a shared pool. This pool is in a fenced in back yard just for you. We keep it in the 70s year round, but feel free to adjust it to suit your personal preferences via a touch screen standing panel on the right side of the pool. We have the tallest one in the market - 3.8 ft. It’s just steps from the hot tub in our outdoor space if you want to do cool plunge and hot tub hydrotherapy! We have a pool lounger and noodle for floating devices in the first bedroom closet. Our pool is also family-friendly- we have a safety ladder that locks so kids can stay out when you’re not ready to supervise them.
✹ Our hot tub comfortably holds 4-6 people and comes w/ 30 jets + biometric magnetic therapy. It sits under glowing string lights on a covered patio. It is surrounded by privacy curtains.
✹ Deep tissue massage chair + mobile massage therapist available (additional fee) I can vouch for her as I have used her twice! She gives my chronic back pain relief! Details provided after booking.

✹ Don’t worry about doing any chores before you leave. We charge exactly what our cleaners charge and also don’t make our guests do ANY chores. We pride ourselves in providing one of the cleanest accommodations you will ever stay in. We have hired the best and most highly reviewed cleaners in the area to ensure the space is immaculate. They charge us to turn over a place that potentially has four sets of linens to wash and dry, a hot tub to clean and maintain, a pool to clean and maintain, a full-sized kitchen and two dining areas to scrub down, and two bathrooms to make spotless from top to bottom. Our cleaners wipe down and sanitize all surfaces and stick to the strictest Covid cleaning protocols. Short-term rental cleaners also do so much more than regular home cleaners, including taking inventory of anything missing or broken and making sure everything in the home is running properly. Alot of effort goes into keeping the space immaculate and functioning optimally from one guest to the next. This is one area we will not budge on in terms of providing superior quality and service, so we chose the best cleaners in the area.
✹ We provide a starter kit of paper products but guests who plan on staying longer than 2-3 days will most likely need to supply their own once the starter kit runs out.
✹ Please bring your own firewood for the fire pit. There are several areas nearby that have firewood for sale- info in welcome email messages.

By booking this property, you agree to all the following rules and terms as outlined in document.
POLICIES: Please treat the Owner’s Rental Property with the care you would at your own home and abide by the following policies or risk extra charges being added. Behave as you would in any home in which you live, with respect for property and neighbors.
COPY OF ID: A copy of your ID is required to hold your vacation rental reservation. Upon receiving your ID and reading this rental agreement, your reservation will be confirmed and a rental confirmation will be emailed to you.
DAMAGES TO PROPERTY: We do not require a security deposit/damage deposit, but please note that your payment method on your booking platform may be charged if you cause damage during your stay that involve either of the following: (a) Damage is done to the property or its furnishings, or (b) Items are missing from the property. This agreement is a short-term vacation rental contract and differs in Texas law from that of a residential lease. The property manager/owner or representative has the right to enter the property with reasonable notice for the protection, inspection, or
maintenance of the property, and/or enforcement of this agreement up to but not limited to fulleviction and payment of additional damages charged to your payment method on booking site. Please use common courtesy at the Rental Property by keeping it clean, reporting any problems or damages, washing dishes as used, taking garbage to the outside bins, leaving towels in the bathrooms and sheets in the bedrooms, and not taking apart furniture. Taking apart the furniture will result in a mover’s fee of $350.00 to rearrange the furniture back into its place in addition to being held liable for any damage that was caused.
TERMS AND CONDITIONS: You must be 25 years of age to rent this property. By booking this vacation rental, you acknowledge that you are 25 years of age or older. Proof of age with valid ID is required at check-in. Any falsification of age will result in immediate eviction.
SECURITY CAMERAS: 3 video security cameras are located on the property for safety, security, and to aid law enforcement. These three cameras are outside the home - on the left side of the house, the right side of the house, and on the doorbell. No cameras are in the hot tub area. All recording shall be done with recognition of the reasonable expectation of privacy. Security cameras are solely for visual and audio monitoring outside the property and are not present inside the property. Renter agrees not to tamper with the security cameras. Renter understands that property is armed before check-in time and after check-out time and alarms will sound if present beyond the agreed upon check-in and check- out time.
NOTICE TO VACATE: Your reservation ends on your checkout date and your checkout time, 11:00 am. Note that your keyless entry code will expire at 11:00 am, your checkout time.
LATE CHECKOUT FEE: Without a previous authorization from your host, you will incur an additional late checkout fee should you fail to checkout by 11:00 am. We need this time between bookings for our cleaners to do a thorough job for the next renters.
OCCUPANTS: By booking this vacation home, you acknowledge that you are responsible for the conduct of all persons you invite or allow to remain on or in the property during the dates of this reservation. Your reservation is confirmed for only the number of guests listed on your confirmation and upon check-in, you will be required to complete a Guest Registration Form listing the names and ages of all persons who will be on the premises. The property has a guest maximum occupancy of 12 adults and children at any given point in time, day or night including interior, exterior, grounds, driveways, backyard and pool but only 8 maximum adults are allowed overnight, with 2 maximum adults per sleeping area. (Air mattress can fit in living room or gym area). Exceeding this occupancy limit or falsifying occupancy is strictly prohibited. Violation of the Occupancy Limit will result in immediate eviction. Notice that failure to conform to the occupancy requirements is also a violation of the city code and occupant or visitor can be cited. No overnight sleeping outdoors. Only guests noted are allowed overnight. House parties, social events, and/or ANY activity where guests not listed on the Guest Registration or exceeding the occupancy limit are invited including dinners and family reunions are strictly prohibited. Any violation will result in immediate eviction.
SUBLEASING: Subleasing the property or advertising the property in any form, including but not limited to, digital or social media is strictly prohibited.
CONDUCT: As the responsible party booking this vacation rental, you must personally be in residence during the entire stay and when requested by law enforcement or other authority you must provide a copy of this agreement. By booking this vacation rental, you acknowledge that you are responsible for the conduct of all persons you invite or allow to remain on the property during the time of your reservation. Any guest(s) engaging in or arrested for any illegal activity including the possession of illegal substances is strictly prohibited anywhere in or on the property. The Guest(s) will be subject to immediate eviction.
NOISE: You must comply with all city noise ordinances. No loud noise is allowed after 11:00 pm or before 6:00 am Friday and Saturday or after 10:00 pm or before 6:00am Sunday through Thursday. No parties or noise that can be heard beyond the Rental Property lot line or in adjacent properties or any illegal activity may occur at the Rental Property. If at any time the maximum number of the Rental Property’s occupants is exceeded or if we receive information about excessive noise, the Owner has the right to evict the Guest and all occupants immediately with no refund for the balance of the remaining reservation.
FIREWORKS: Fireworks are prohibited by city ordinance, both on private and public property.
MOBILE MASSAGE THERAPIST: You understand that the mobile massage therapist recommendation is an independent contractor and a separate entity and business. If you give your consent to receive massage services and/or other bodywork or treatment from the mobile massage therapist, you acknowledge and agree that you are doing so at your own risk. Your health and safety with respect to such Services are your sole responsibility. In exchange for receiving Services, You, for yourself and on behalf of your heirs, executors, administrators and personal representatives, hereby waive, release, discharge and hold harmless the owner, Midori Heckman and Heckman Home LLC, from any and all liability for any and all injuries, including death, damages or claims relating to or resulting from your receipt of the Services, now or in the future, foreseen or unforeseen. Further,
you will indemnify and hold Midori Heckman and Heckman Home LLC, harmless from and against any and all claims, rights, damages, liabilities, losses, costs and expenses (including reasonable attorneys’ fees) arising from or in connection with any injuries to other persons or damage to property caused by or attributed to me. Acknowledgement: By voluntarily and knowingly booking this vacation rental, you are acknowledging that, among other things: you have carefully read this entire release and waiver, understand its terms without reservation and, accordingly, your Relatives and you are waiving substantial legal rights.
PEST CONTROL: Every effort is made to eliminate the occurrence of pests in our home. This rental property is serviced for pests by a licensed professional exterminator on a regular basis. As many insects are indigenous to our area - particularly ants, mosquitoes, and palmetto bugs - we recommend keeping all doors and windows closed and that you do not leave food on counters or tables. No other arrangements, property substitutions, rate adjustments, or refunds will be issued for pest-related problems.
EARLY DEPARTURE: Once the property has been occupied, no refund will be due if the guest decides to vacate the property before the end of the rental period.
HOUSEKEEPING AND OTHER MATTERS When you arrive, the property will be clean and set up with linens. We have included the following supplies to accommodate the appropriate number of guests:
• Bath towels, hand towels, wash cloths, and makeup cloths. Please refrain from using white towels to remove makeup. Beach towels are also provided by the back door for hot tub use.
• Initial supply of dishwashing soap, hand soap, paper towels, toilet paper, lotion, shampoo, conditioner, and body wash, but these items will not be replaced if consumed during your stay, so we recommend bringing additional personal items with you.
CLEANLINESS: Alert us immediately if anything breaks. Clean up spills and crumbs. Wash your dishes.
PETS: This is a private Rental Property and pets are NOT allowed. If any sign of a pet is discovered, then the Guest authorizes the Owner to charge the Guest an additional minimum $500.00 cleaning fee. The owner has the right to evict the Guest and all occupants immediately with no refund for the
balance of the remaining reservation if a pet is discovered.
SMOKING: This is a non-smoking property. When smoking outside of the property, the doors to the property must be kept closed and butts must be safely and properly disposed. If smoking is detected inside the property, your credit card on file will incur additional charges. No smoking/tobacco
products, vaping, marijuana, or other illegal drugs are allowed in or around the Rental Property.
PHONE AND INTERNET: The Rental Property is equipped with a high-speed Wi-Fi connection and we will provide you with any required Wi-Fi passwords. A landline is NOT provided, and we suggest that you please use your mobile phone or Wi-Fi enabled phone for calls.
MAINTENANCE AND ACCESS: We have the right to enter the Rental Property at any time during guest stay and we will diligently attempt to address maintenance issues as they occur. This is an associated risk of renting a single-family residence. If a maintenance issue occurs that cannot be fixed in a reasonable amount of time or if the Rental Property is unavailable for any reason as determined in our discretion, and significantly affects your stay; we reserve the right to refund at our discretion and the Guest expressly acknowledges that in no event shall Owner be held liable for any special or consequential damages which result from this unavailability.
PARKING: Vehicle parking is limited to designated spaces at the property - 2 vehicles on the right side gravel driveway, and 1 vehicle on the left side. Additional street parking may be available for guests but is not guaranteed. Parking in other than a designated place will result in the towing of your vehicle. Do not park on grass or on any landscaped areas. Notice that failure to conform to the parking requirements is a violation of the city code and occupant or visitor can be cited.
SAFETY: Lock all doors when you leave the house to keep your personal items safe. Additionally, a safe is provided for your convenience at the top of the closet in the first room. Property owner is not liable or responsible for personal items left behind, lost or stolen. If you leave an item behind and
wish to have it returned, call us as soon as possible and if found, we will arrange for shipment. The guest is responsible for all shipping costs for any Lost and Found items that Owner is requested to return to the Guest. Items found and not claimed within 30 days will be disposed of at the discretion
of the Owner. The guest acknowledges that the guest is solely responsible for his or her own safety as well as that of their guests and any children. This Rental Property is not childproof. There are breakables, toxic cleaning materials, choking hazards, electrical plugs, cabinets, and other potential
hazards within reach of small children. Guest/parents/guardians assume all risks. Use of any part of the property (stove, grill, etc.) may be dangerous and involve potential risks if improperly used. Such use is solely at the Guest’s own risk. Guest shall use this Rental Property for residential purposes only and in a careful manner to prevent damage to the rental property. Guests always agree to keep the property clean and in a sanitary condition. Guests shall not use this Rental Property for any immoral, offensive, or unlawful purpose, nor violate any laws and rules.
PATIO: The Rental Property has a small patio. Patios can be slippery when wet and can result in injury to anyone who is not careful. Guest accepts and assumes all risks involved in or related to the use of the Rental Property, including the patio areas.
ADULT USE: The patio, electric grill, exercise machines, exercise equipment, bidet, towel warmer, nugget machine, massage chair, air fryer, fire pit, and hot tub are provided for the enjoyment of adult guests. Keep children away from these areas unless there is constant adult supervision. Owner is
not responsible for accidents and/or injuries.
WATER AND SEPTIC DO NOT FLUSH: anything other than toilet paper in toilets. NO feminine products, wipes, diapers or foreign objects should ever be flushed. If it is found that misuse has resulted in clogging the sewer system, you could be charged for damages.
GLASSWARE: No glassware is allowed outside of the home. Plastic wine glasses and plastic glasses are provided for your convenience and can be used outside.
CHECK IN: Check in time is 4:00 pm CST at 225 Utah Street, San Antonio, Texas 78210. Please respect this time as in many cases the property has been rented the night before and we require time to prepare for your stay. Note that if you arrive before the check in time, the security system will
be armed.
CHECK OUT: Check out time is 11:00 am CST. Beds should be left unmade. Please do not strip beds. Make sure all doors and windows are locked and shut. Double check for left behind belongings. Please put furniture back to its original location.
CANCELLATION POLICY: No refunds will be granted for cancellations due to weather.
FORCE MAJEURE: There may be circumstances beyond our control and contemplation, in which the property might not be available for your booking. Examples of these include (but are not limited to) extended power or other utility outage (lasting more than one day), severe weather, destruction of or severe damage to the property. In the event of Force Majeure, we will do our best to make alternative arrangements for you where possible. If we cannot, or if the alternative arrangements are not
acceptable to you, then we will refund all monies paid. This will be the full extent of our liability to you in such circumstances, and we will not be responsible for any other costs connected with any such cancellation, I UNDERSTAND AND AGREE THAT THE OWNER OF THE PROPERTY WILL NOT BE LIABLE UNDER ANY LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE FOR ANY PROPERTY DAMAGE, BODILY INJURY OR DEATH TO RENTER, FAMILY OR GUESTS OF RENTER, FROM OR DUE TO ANY CAUSE OR ACTION, ARISING DURING THE OCCUPANCY OF THE SAID PROPERTY INCLUDING BUT NOT LIMITED TO USE OF EXERCISE EQUIPMENT AND EXERCISE MACHINES, HOT TUB, FIRE PIT, ELECTRIC GRILL, STOVE, EXERCISE MACHINES, EXERCISE EQUIPMENT, BIDET, TOWEL WARMER, NUGGET MACHINE, MASSAGE CHAIR, AND AIR FRYER BY TENANT, FAMILY OR GUESTS.
ENTIRE AGREEMENT: This Agreement represents the entire understanding and agreement between the Owner and Guest with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings and representations made by and between the Owner and Guest.
SEVERABILITY: If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement. We take our guests safety and wellbeing very seriously and have rules in place to ensure that no one gets hurt while you enjoy your stay at The Organic Modern. Please read this waiver in its entirety. Failure to follow these rules will result in additional charges, asking you to leave the property or both.
HOT TUB RULES
• Please shower before using the hot tub to remove all lotions and oils
• Do not remove water from the tub. If left running below minimum water levels, it can break the electrical components. If this occurs, you will be billed for the damages and work needed to have it fixed.
• No soap or oils are allowed
• No more than 6 people at a time
• Use the stairs to enter and exit the hot tub
• Do not use the hot tub alone
• Do not use the hot tub if the water temperature is more than 104˚F
• Absolutely NO glass of any kind allowed in or around the hot tub
• Anyone under 18 must be supervised by an adult. Children under 13 are not allowed
• Elderly or pregnant women should not use the hot tub
• People with heart disease, high or low blood pressure, diabetes or other illness should not use the hot tub
• People using alcohol or other drugs should not use the hot tub without consulting a physician
• No sex or nudity allowed in the hot tub
• Please do not pee in the hot tub
• Limit your time to 15 minutes and cool off before re-entry
• Do not use the hot tub cover as a table or a seat
• Please turn off the jets and put the hot tub cover back on after use
HOT TUB WAIVER
You, (“Guest”), a visitor to and short term vacation renter, rented from Midori Heckman (“Owner”), acknowledge that you are informed and aware that: There is a hot tub / spa on the property, it poses a risk to any and all guests on the property. These risks may result from a variety of circumstances
including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of yourself or others, or from the unavailability of emergency medical care.
Guest understands that a hot tub is available on the property for their private use. Guestassumes any and all liability from use of said hot tub. Guest will keep the hot tub closed and cover locked when not in use, and will supervise any children over the age of 12 and under the age of 18 when using the hot tub. By using the hot tub, Guest agrees to assume all liability from said use and hereby indemnifies Owner. Guest specifically accepts ALL liability for use of the hot tub on the property and understands that Owner, shall have no liability from any accidents, injuries, or death that may result from the proper or improper use of said hot tub. Guest accepts said liability by voluntary use of said hot tub. The hot tub water is checked immediately after guests leave – in the event the water is ruined, and needs to be replaced because of food, beverages, soap, makeup, glass, dirt, etc. there will be a charge of $200.00 to clean, refill, heat and sanitize the hot tub and
water. You are also aware that Guest’s stay at the Property involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property
during your stay, and the condition of the Property. You understand that the description of the risks in this Release of Liability, Waiver of Claims and Assumption of Risk (the “Document”) is not complete and that other risks or events that are known or unknown, anticipated or unanticipated may result in serious bodily injury and or/death. In consideration of being permitted to rent and stay at the Property, You agree on your own behalf and on behalf of your family and guests and on behalf of your children and all minors in your care, custody or control (hereafter also included in “You” or “your”) to assume full responsibility for the risks identified herein and those risks not specificallyidentified. You hereby release from liability and waive any and all
claims that you have or may have in the future against the Owner and its members, principals, agents, officers, employees, and representatives (collectively “Releasees”) as well as the landlord/owner of the Property. You agree to fully and forever release and discharge, and not to sue Releasees for any injuries or damages, including property damage that may result from, arise out of or be related in any way to your rental and stay at the Property. If any portion of this Document shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Document and the remainder of the Document shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. By booking this vacation rental, you assume all risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with activities and events during or related to the stay in the subject property. YOU ACKNOWLEDGE THAT YOU HAVE READ THIS ENTIRE DOCUMENT AND THAT YOU UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. YOU UNDERSTAND THAT THE EFFECT OF THIS
DOCUMENT IS THAT YOU ARE RELEASING LIABILITY AND WAIVING YOUR RIGHT TO SUE RELEASEES AND YOU ARE ASSUMING RISK FOR MATTERS RESULTING FROM, ARISING OUT OF OR RELATING IN ANY WAY TO YOUR RENTAL AND STAY AT THE PROPERTY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH AND PROPERTY DAMAGE. YOU ACKNOWLEDGE THAT THIS DOCUMENT APPLIES EVEN IF RELEASEES MAY BE NEGLIGENT IN WHOLE OR PART. YOU UNDERSTAND THAT THIS DOCUMENT APPLIES TO AND SHALL BE EFFECTIVE AND BINDING UPON YOU, YOUR HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, ESTATE, AND ALL MEMBERS OF YOUR
FAMILY, MINORS, AND OTHERS IN YOUR CARE, CUSTODY OR CONTROL.
EXERCISE EQUIPMENT AND EXERCISE MACHINES WAIVER In consideration of receiving permission to utilize the exercise equipment located within this property, you hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the owner, Midori Heckman from any and all liability, claim, demands, actions and causes of action whatsoever arising from or related to any loss,
damage, or injury, including death, that may be sustained by you, or to any property belonging to you, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise, while participating in such athletic activity, or while in, on or upon the premises where the activity is being conducted. To
the best of knowledge, you are in good physical condition and are not aware of any physical infirmity which would place you at risk in using such equipment. YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISK OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING
DEATH, that may be sustained by you, or any loss or damage to property owned by you, as a result of being engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise. You further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from
any loss, liability, damage or cost, including court costs and attorney’s fees, that they may incur due to your participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise. It is your express intent that this Waiver of Liability and Hold Harmless Agreement shall
bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representative, if you are deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES, you hereby further agree that this Waiver of
Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Texas. In booking this vacation rental, you acknowledge and represent that you have read and understand it and book it voluntarily; you are at least eighteen (18) years of age and fully competent;
and you execute this Release for full, adequate and complete consideration fully intending to be bound by same. YOU HAVE READ THIS WAIVER OF LIABILITY AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT YOU HAVE GIVEN UP SUBSTANTIAL RIGHTS BY BOOKING IT, AND BOOK IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
INDEMNITY: The owner does not assume any liability for loss, theft, damage, or injury to the Guest, his/her guests, or other occupants in the Home. The Guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Owner from any and all claims, demands, and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the Guest, his/her guests or other occupants of the home as a result of, or in connection with the occupancy of the Home and agrees to hold Owner free and harmless of any
claim or suit arising therefrom. In any action concerning the rights, duties, or liabilities of the parties to this Agreement, all litigation must be handled in San Antonio, Texas (location of the property.)
AND RELEASE OF LIABILITY

In consideration for the privilege of temporary use of the cowboy
pool the undersigned hereby agrees that
1. I understand that there are inherent risks involved in participating and use of swimming pools and
related facilities, including the risk of serious physical injury or death and I FULLY ASSUME ALL RISKS
ASSOCIATED WITH THIS ACTIVITY, EVEN IF DUE TO THE NEGLIGENCE OF THE OWNER
AND HER AGENTS, SERVANTS, OR EMPLOYEES, which said risks shall include but not limited to
Variations in weather conditions; equipment failure; lack of safety devices or inadequate safety devices; lack of warnings or inadequate warnings; lack of instructions or inadequate instructions; and the like.
2. I acknowledge receipt of and agree to adhere to all rules regarding the use of the cowboy pool. I
agree to using the cowboy pool that is not being monitored by a Life Guard.
3. I agree that this participation is at the discretion of the owner and if the participant fails to follow the pool rules, he or she will be responsible for any and all situations that may arise as a result of negligence.
4. I acknowledge that the owner does not provide accident or hospitalization insurance for participants and that I will be fully responsible for any such costs. All participants are advised to have adequate personal coverage.
5. I agree that the owner and its employees, agents, and officials, shall not be legally responsible for any loss, injury or damage resulting from any cause, including negligence of any party, and that I for myself and for my heirs, assigns, successors, executors, administrators, and legal representatives, agree to indemnify and hold harmless the owner, and its boards, commissions, agents, officials, and employees, harmless and indemnify then from and against all claims, suits, damages, losses, judgments, costs and expenses, including attorney's fees, from any claims, including claims of negligence, on the part of the owner and their agents, servants or employees, which may directly or indirectly result from or occur as a consequence of the use, presence, activities, or program conducted within, upon, or accessing said cowboy pool or use of equipment.
I HAVE READ THIS WAIVER, HOLD HARMLESS AGREEMENT AND RELEASE OF LIABILITY AND FULLY
UNDERSTAND ITS TERMS. I FURTHER UNDERSTAND THAT BY BOOKING THIS STAY THAT I AM
GIVING UP SUBSTANTIAL LEGAL RIGHTS. I HAVE NOT BEEN INDUCED TO BOOK THIS STAY BY
ANY PROMISE OR REPRESENTATION, AND I SIGN IT VOLUNTARILY AND OF MY OWN FREE WILL.
CONSENT OF PARENT OR GUARDIAN
1. This is to certify that I, as parent or guardian for, the child or children listed in the booking, and with
legal responsibility do hereby consent, agree to the release as set forth above, on behalf of my child or ward, (Participant) and his or her, and myself, heirs, assigns, successors, executors, administrators, and legal representatives, and agree to indemnify and hold harmless the owner, and its boards,
commissions, agents, officials, and employees, from and against all claims, suits, damages, losses, judgments, costs and expenses, including attorney's fees, including claims of negligence on the part of the owner, servants or employees, which may directly or indirectly result from or occur as a consequence of the use, presence, or activities conducted within, upon, or accessing the cowboy pool or use of owner equipment arising from said participant’s use of the cowboy pool.
2. I hereby release the owner, its employees, officials and agents from any and all liability or
loss or damage to personal property that, my child or ward or I may experience in connection with activities provided by the owner or use of a cowboy pool.
3. I hereby grant permission for emergency medical procedures deemed advisable for the participation in the event of injury or illness during participation unless otherwise noted on this form.
4. I acknowledge that the owner does not provide accident or hospitalization insurance for participants and that I will be fully responsible for any such costs. All participants are advised to have adequate personal coverage.
I HAVE READ THIS WAIVER, HOLD HARMLESS AGREEMENT AND RELEASE OF LIABILITY AND FULLY
UNDERSTAND ITS TERMS. I FURTHER UNDERSTAND THAT BY BOOKING THIS STAY THAT I AM
GIVING UP SUBSTANTIAL LEGAL RIGHTS. I HAVE NOT BEEN INDUCED TO BOOK THIS STAY BY
ANY PROMISE OR REPRESENTATION, AND I BOOK IT VOLUNTARILY AND OF MY OWN FREE WILL.
